• Health Considerations: Participants should ensure they are in good physical health to engage in Level X activities. Those with health concerns should seek medical advice before participating.

Participation:

• Enrollment and Fees: Participants must complete the official registration for Level X and agree to a participation fee of $180 for the 180-day program. Additionally, there is a non-refundable Decision Fee of $18 to cover associated program costs.

• Program Adherence: Participants are expected to engage honestly with Level X, following the program’s daily habits and weekly challenges as outlined.

• Accountability and Reporting: Accurate self-reporting of daily activities and scores is crucial. Misrepresentation may lead to disqualification.

• Communication: An active email account is required for program communications. Participants should stay informed of updates and changes.

• Conduct: Respectful and positive conduct is expected of all participants. Inappropriate behavior may result in disqualification.

• Voluntary Participation: Joining Level X is voluntary. Participants may withdraw at any time, understanding that withdrawal affects their eligibility for rewards and recognition.

Limitation of Liability:

Eyrth is not liable for any harm or loss resulting from participation in Level X, except as prohibited by law.

Acceptance of Terms:

Registration and payment for Level X constitute agreement to these terms, confirming understanding and eligibility.

2. Code of Conduct

Purpose:

The Level X program is committed to providing a supportive, respectful, and inclusive environment for all participants. This Code of Conduct outlines the standards of behavior expected from participants to maintain the integrity and positive atmosphere of our community.

Respect and Courtesy:

• Mutual Respect: Participants must treat each other with respect and courtesy at all times. Disrespectful, inappropriate, harassing, or offensive behavior will not be tolerated.

• Diversity and Inclusion: Embrace and respect diversity in all its forms. We encourage a culture of inclusivity and understanding.

Positive Engagement:

• Actively engage in program activities, discussions, and challenges.

Integrity and Honesty:

• Honest Participation: Maintain honesty in all program-related activities. This includes accurate self-reporting of habits, challenges, and scores.

• Fair Play: Engage in the program in good faith and in the spirit of fair competition. Avoid any form of cheating, fraud, or deception.

Communication:

• Constructive Communication: Foster positive and constructive interactions within the community. This includes digital communications on the platform and in any related forums or discussion groups.

• Privacy and Confidentiality: Respect the privacy of other participants. Do not disclose personal information without consent.

Consequences for Non-Compliance:

Failure to adhere to this Code of Conduct may result in corrective action, up to and including disqualification from the program and forfeiture of any potential rewards or recognition.

3. Challenges and Submissions

Purpose of Challenges:

Level X is designed to engage participants in various challenges aimed at fostering personal growth, skill development, and community engagement. These challenges form an integral part of the program and contribute to the overall experience and scoring system.

Nature of Challenges:

• Challenge Variety: Challenges may vary in nature, including but not limited to physical activities, mental exercises, creative tasks, and community interactions.

• Weekly Announcements: New challenges will be announced weekly and are expected to be completed within the specified timeframe.

Submission of Evidence:

• Proof of Completion: Participants are required to submit evidence of challenge completion, which may include photos, videos, or written descriptions, as specified in the challenge guidelines.

• Token Item Inclusion: Each submission must include the designated token item for the week, ensuring the authenticity of the participation.

• Deadline Compliance: Submissions must be posted by 8 PM EST every Sunday. Late submissions will not qualify for bonus points or may be deemed invalid.

Honesty and Integrity:

• Accurate Representation: Submissions must accurately represent the participant’s personal effort and completion of the challenge. Misrepresentation or submission of false evidence will result in penalties.

• Originality: All submissions must be the original work of the participant and not plagiarized or copied from other sources.

Use of Submissions:

• Permission for Use: By submitting challenge evidence, participants grant Eyrth the right to use these submissions for program-related purposes, including promotional activities and community sharing.

• Respect and Appropriateness: Submissions must adhere to community standards of respect and appropriateness. Inflammatory, offensive, or inappropriate content will lead to disqualification.

Feedback and Improvement:

• Constructive Feedback: Participants may receive feedback on their submissions from Eyrth team members or other participants. This feedback is meant to be constructive and supportive.

Consequences of Non-Compliance:

Failure to adhere to these guidelines may result in disqualification from the challenge, deduction of points, or other corrective actions as deemed necessary by Eyrth.

Acknowledgment:

By participating in Level X and submitting challenge evidence, participants acknowledge their understanding and agreement to these terms.

4. Challenge Continuation Policy

The Level X course will take place regardless of the number of participants. However, the contest portion, including the grand prize of $10,000, will only occur if at least 180 participants are enrolled in the program. Participants will be notified if the contest criteria are not met.

Participants from California who are unable to continue the program due to circumstances beyond their control (e.g., medical issues, personal emergencies) may request to be added to the next available challenge instead of receiving a refund. This request must be submitted in writing within one year from the start date of the current program.

5. Prizes and Awards

Awarding of Prizes:

Level X is committed to recognizing and rewarding the efforts and achievements of its participants. Prizes and awards are given to encourage continuous engagement and acknowledge outstanding performance in the program. The contest and associated prizes will only be held if at least 180 participants are enrolled.

Types of Prizes and Awards:

• Grand Prize: The participant with the highest cumulative score at the end of the 180-day program will receive a grand prize of $10,000.

• Weekly and Monthly Recognition: Throughout the program, there may be opportunities for participants to receive recognition or smaller prizes based on weekly or monthly performance, challenge completions, or other noteworthy contributions to the community.

Eligibility for Prizes:

• Compliance with Program Rules: To be eligible for prizes, participants must adhere to all program guidelines, including the Code of Conduct and the Challenges and Submissions requirements.

• Score Verification: Eligibility for the grand prize is contingent upon verification of the participant’s cumulative score and adherence to program rules.

Distribution of Prizes:

• Grand Prize Distribution: The grand prize will be awarded within one month following the conclusion of the 180-day program, provided the contest criteria are met.

• Method of Prize Delivery: Prizes will be delivered via check, bank transfer, or another agreed-upon method, subject to the participant’s location and applicable financial regulations.

Tax Responsibility:

• Prize Recipients’ Obligation: All prize recipients are responsible for any taxes, fees, or other charges associated with the receipt or use of any prize.

No Prize Transfer or Substitution:

• Non-Transferability: Prizes are non-transferable and must be accepted as awarded. No cash or other substitution may be made, except by Eyrth, who reserves the right to substitute a prize with another prize of equal or greater value if the advertised prize is not available.

Acceptance of Prizes:

• Acknowledgment Required: Acceptance of any prize constitutes permission for Eyrth to use the winner’s name, likeness, program entry, and/or comments for promotional purposes without further compensation, except where prohibited by law.

Disputes and Clarifications:

• Resolution of Disputes: Any disputes or clarifications regarding the prizes and awards should be directed to the Eyrth team for resolution.

Tiebreaker Process for Level X:

In the event of a tie where multiple participants achieve the highest cumulative score at the end of the Level X program, the following tiebreaker process will be implemented to determine the winner of the grand prize:

1. Consistency of Participation: The frequency and regularity of a participant’s engagement with the daily habits and weekly challenges will be evaluated. The participant who has demonstrated the most consistent participation throughout the program will be favored.

2. Quality of Community Engagement: Participants’ contributions to the community aspect of Level X, including positive interactions, support for fellow participants, and overall involvement, will be assessed. A participant who has positively impacted the Level X community will be given preference.

3. Improvement Over Time: The degree of personal growth and improvement shown by participants over the course of the program will be considered. This includes not only the improvement in scores but also the development in personal habits and skills.

If, after applying these criteria, a tie still exists:

• Random Draw: A random draw will be conducted among the tied participants to select the winner. This draw will be carried out transparently and with integrity to ensure fairness.

Eyrth reserves the right to make the final decision in the case of a tie, and the outcomes of the tiebreaker process are final and binding.

Additional Winners:

Eyrth reserves the right to designate additional winners in the Level X program, contingent upon the number of participants and overall engagement in the program. This decision is made at the sole discretion of Eyrth and is dependent on various factors, including participant numbers and the dynamics of the program as it progresses.

Should the decision be made to award additional prizes, the details regarding the number of additional winners, the nature of their prizes, and the criteria for selection will be communicated to all participants prior to the program’s conclusion.

Participants are encouraged to focus on their personal development journey throughout Level X, with the understanding that the primary reward is the growth and skills gained during the program. Any additional prizes are supplementary to this primary objective.

6. Refund Policy

No-Refund Policy:

By enrolling in the Level X program and processing your payment, you are agreeing to the following no-refund policy:

• Payments made for participation in the Level X program are non-refundable. This policy applies to the entire duration of the 180-day program, including the non-refundable Decision Fee of $18.

Participant Responsibility:

• It is your responsibility as a participant to ensure your commitment and ability to participate in the Level X program before proceeding with any payments.

Prize Fund Allocation:

• Your payments contribute to the prize fund, which includes the grand prize awarded to the program winner. To preserve the integrity of the prize structure, refunds cannot be issued.

Payment Authorization:

• By making a payment, you authorize Eyrth and its designated payment processor to charge the specified amount for your participation in Level X, including the Decision Fee.

Understanding the Terms:

• Participants are expected to fully understand the terms and conditions of Level X, including this no-refund policy. Please read all program materials and policies carefully.

Disqualification:

• Any participant disqualified from the program due to a violation of the program rules or Code of Conduct will not be entitled to a refund.

Moderation and Enforcement:

• Monitoring: Eyrth reserves the right to monitor UGC but is not obligated to review all content shared on the platform.

• Warning: Issuance of a formal warning to the participant regarding their non-compliant behavior.

• Content Removal: Removal of any participant-generated content that violates the program’s guidelines.

22. Indemnification Clause

Participants agree to indemnify, defend, and hold harmless Eyrth, its affiliates, directors, officers, employees, representatives, agents, and successors from any claims, liabilities, losses, damages, costs, expenses (including reasonable attorneys’ fees), or demands, directly or indirectly related to or arising out of their participation in the Level X program.

Basis of Claims:

This indemnification covers, but is not limited to:

• Claims resulting from the participant’s breach of the terms and conditions of Level X, violation of any laws or rights of a third party, or any other wrongful acts or omissions.

• Participation in Level X: Including any activities, actions, or engagement in the program.

• Violation of Terms and Conditions: Any breach of the terms, conditions, or agreements set forth in the Level X program.

• User-Generated Content: Including any content submitted, posted, or shared by the participant within the program.

• Rights Violation: Any violation of rights, including intellectual property rights, privacy rights, or any other rights, by the participant.

• Injury or Harm: Any injury, harm, or damage caused by the participant’s actions, negligence, or misconduct.

• Third-Party Claims: Claims brought by third parties as a result of the participant’s actions or participation in Level X.

• Data Breach and Privacy Violations: Claims arising from breaches of data security or privacy violations attributable to the participant.

• Misrepresentation: Claims resulting from any misrepresentation, false statements, or fraudulent activities by the participant in Level X.

• Regulatory Violations: Claims arising from violations of laws, regulations, or industry standards by the participant.

• Intellectual Property Infringement: Claims related to the infringement of third-party intellectual property rights by the participant, including trademarks or copyrights.

• Defamatory Content: Claims resulting from defamatory statements or content published by the participant in Level X.

• Breach of Confidentiality: Claims arising from the participant’s unauthorized disclosure of confidential information or breach of confidentiality obligations.

• Non-compliance with Rules: Claims resulting from the participant’s failure to comply with the rules, guidelines, or instructions of Level X.

• Physical Injury or Property Damage: Claims related to any physical injury or property damage caused by the participant’s actions during Level X.

• Non-adherence to Challenge Guidelines: Claims resulting from the participant’s failure to follow the guidelines, terms, or conditions of Level X.

Defense and Cooperation:

• Notification and Cooperation: Participants shall promptly notify Eyrth of any claim or legal proceeding and cooperate fully with Eyrth in the defense of such claim or proceeding.

• Control of Defense: Eyrth reserves the right to assume the exclusive defense and control of any matter subject to indemnification by the participant, in which case the participant will cooperate with Eyrth in asserting any available defenses.

Limitation of Indemnification:

• Conduct Exclusions: Indemnification does not extend to actions or omissions by Eyrth that are found to be grossly negligent or willful misconduct.

• Legal Compliance: This indemnification clause is intended to be applied to the fullest extent permitted by law and shall be limited as necessary to comply with state, federal, and international laws.

• Survival of Obligation: This indemnification obligation will survive the termination of the participant’s involvement in the Level X program and any agreement between the participant and Eyrth.

23. Dispute Resolution Clause

Eyrth is committed to resolving disputes arising out of or in connection with the Level X program in a constructive and timely manner. We encourage participants to approach disputes with the intention of achieving an amicable resolution.

Initial Resolution Attempt:

• Direct Communication: Participants are encouraged to first attempt to resolve any disputes directly with Eyrth’s support or management team. Eyrth will make a reasonable effort to address and resolve participant concerns promptly and effectively.

• Written Notification: Any unresolved issues should be formally brought to Eyrth’s attention through written notification, outlining the nature of the dispute and the desired resolution.

Mediation:

If direct resolution attempts are unsuccessful, Eyrth and the participant agree to engage in mediation as a means to resolve the dispute. The mediation process shall be:

• Conducted in Good Faith: Both parties agree to participate in the mediation process in good faith with the aim of reaching a mutually satisfactory agreement.

• Confidential: Mediation discussions shall be confidential and shall not be used as evidence in any subsequent arbitration, litigation, or other dispute resolution processes.

• Costs of Mediation: The costs of mediation shall be shared equally between Eyrth and the participant, unless otherwise agreed upon during the mediation.

Arbitration (If Applicable):

• Binding Arbitration: If mediation does not resolve the dispute, the parties may agree to submit the dispute to binding arbitration. The arbitration process will be governed by the rules of a mutually agreed-upon arbitration association.

In order to enhance the participant experience in the Level X program, Eyrth collaborates with Mighty Networks, an external platform, for various program-related functionalities. This collaboration involves the utilization and transfer of certain participant data to Mighty Networks.

Scope and Purpose of Data Transfer:

• Data Types: The data transferred may include, but is not limited to, participant names, email addresses, participation records, and other relevant information necessary for effective program management and participant engagement on the Mighty Networks platform.

• Transfer Purpose: The purpose of this data transfer is to facilitate program operations, including community interaction, content delivery, and overall program management on Mighty Networks.

Compliance with Mighty Networks’ Terms:

• Acceptance of Terms: By participating in the Level X program and agreeing to our terms and conditions, participants also acknowledge and agree to comply with the terms and conditions of Mighty Networks, as the platform will be an integral part of the program experience.

• Informed Consent: Participants are encouraged to review the terms and conditions of Mighty Networks to ensure they are fully informed about the platform’s policies, particularly regarding data use, privacy, and user interaction.

Eyrth’s Commitment to Data Protection:

• Secure Transfer: Eyrth is committed to ensuring the secure and confidential transfer of data to Mighty Networks.

• Data Usage Limitation: Data shared with Mighty Networks will only be used for purposes directly related to the operation and enhancement of the Level X program.

Participant Responsibilities:

• Understanding Platform Policies: Participants are responsible for understanding and adhering to the policies and guidelines set forth by Mighty Networks, in addition to those of Eyrth.

• Data Accuracy: Participants should provide accurate and up-to-date information to facilitate smooth operations on the Mighty Networks platform.

Acknowledgment by Participants:

By enrolling in and making payment for the Level X program, participants acknowledge and consent to the transfer and use of their data on Mighty Networks and agree to comply with both Eyrth’s and Mighty Networks’ terms and conditions. Participants recognize the importance of understanding and adhering to the policies of both platforms as part of their participation in Level X.
